You are responsible for your own communications and any consequences arising from them. Communities are intended for legal, proper, and community-related messages and material only.

We do not guarantee the truthfulness, accuracy, or reliability of any communications in Communities or endorse any opinions expressed therein. Users should exercise caution when relying on material in Communities as this is done at their own risk.

Intellectual Property Rights

You acknowledge that all present and future copyright and other intellectual property rights in connection with our Service or any part thereof (the "Rights"), including its presentation, are our property (or that of our licensors). Nothing in these Terms of Use transfers any of the Rights to you.

For the sole purpose of receiving the Service, we grant you a non-exclusive, non-transferable license to use the Rights for the duration of the Service provision.

Limitation of Liability

Notwithstanding any other provision, these Terms of Use shall not exclude or limit either party’s liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited.

Your sole remedy under these Terms of Use if you are dissatisfied with the Service or any of its terms shall be to discontinue use of the Service.

We shall not be liable for any failure or delay resulting from any matter beyond our reasonable control.

Other than as set out in this Limitation of Liability section, and notwithstanding any other provision of these Terms of Use, we shall not be liable in contract, tort, negligence, statutory duty, misrepresentation, or otherwise, for any loss or damage whatsoever arising from or connected with these Terms of Use.

All conditions, warranties, and obligations implied or incorporated into these Terms of Use by statute, common law, or otherwise, and any liabilities arising from them, are expressly excluded to the extent permitted by law.

We shall not be liable for any loss of business, loss of profits, business interruption, loss of business information, loss of data, or any other pecuniary loss, even if we have been advised of the possibility of such loss or damage.

In the event that any limitation or exclusion of liability in these Terms of Use proves ineffective, then our liability to you shall not exceed £100 in aggregate. If you register on the Website or any Apps, then only the aggregate cap on liability under the agreement which you enter into upon registration shall apply. If you register as both a “Homeowner” and as a “Trade Business,” then only the aggregate cap in the Trade Business User Agreement shall apply.

We cannot guarantee the day or time of our response to any email, telephone, or written inquiries or Website form submissions.

Each of the provisions of this Clause shall be construed separately and independently of the others.

Our Rights

As Bubble Approved Traders, we retain the authority to edit, decline to post, or remove any information or materials from our platform for any reason, and we reserve the right to disclose any information as required by law, regulation, legal process, police request, or governmental request.

We hold the prerogative to limit your access to our services at any time and without prior notice, should we suspect any material breach of these Terms of Use.

We maintain the right to temporarily or permanently modify or discontinue any aspect of our services, with or without prior notice, and without assuming liability for any such modifications or discontinuations. Any updates or alterations to these Terms of Use will be duly communicated through our platform.

General

Clause headings provided in these Terms of Use serve for organisational purposes only and do not affect the interpretation of the agreement.

In the event that any provision of these Terms of Use is deemed illegal or unenforceable, such provision shall be severed, and the remaining provisions shall remain in full force and effect, unless such severance substantially frustrates the business purpose of these Terms of Use, in which case they shall terminate without further liability.

You may not assign, transfer, or subcontract any of your rights under these Terms of Use without our prior written consent. We reserve the right to assign, transfer, or subcontract any of our rights at any time without requiring consent.

No waiver of any provision shall be effective unless in writing, and no waiver shall prevent us from enforcing any continuing or subsequent breach or default.

These Terms of Use constitute the entire agreement regarding their subject matter and supersede all prior communications, representations (other than fraudulent misrepresentations), and arrangements, whether written or oral. In cases where conflicts arise, the following order of precedence shall apply: the Trade Business User Agreement, the Homeowner User Agreement, and then these Terms of Use.

You acknowledge that you have not relied on any representations not expressly set forth in these Terms of Use.

Notice under these Terms of Use may be provided via email, regular mail, facsimile, or by hand to the address provided on the Website or as otherwise notified.

Nothing herein shall be construed to create or imply any joint venture, principal-agent, or partnership relationship between the parties.

Non-parties to these Terms of Use have no rights under the Contracts (Rights of Third Parties) Act 1999 to rely upon or enforce these Terms of Use.

These Terms of Use shall be governed by the laws of England, and the parties shall submit to the exclusive jurisdiction of the English courts.

Cookies that may be in use on our website:

Type of Cookie: Cookies necessary for essential website purposes.

What it does: These cookies are crucial to provide you with services available through our website and to use some of its features, such as access to secure areas. They enable us to supply you with certain online features like transactional pages and secure login accounts.

How to block: You may disable any of these cookies via your browser settings. However, if you do so, various functions of the website may be unavailable to you or may not work as intended.

Type of Cookie: Functionality Cookies

What it does: Functionality cookies record information about choices you've made and allow us to tailor the website to you. They ensure that when you continue to use or return to the website, we can provide you with our services as you've requested them. For example, these cookies allow us to save your location preferences, remember settings you've applied (such as layout, text size, preferences, and colors), show you when you're logged in, and store accessibility options.

How to block: You may disable any of these cookies via your browser settings. However, if you do so, various functions of the website may be unavailable to you or may not work as intended.

Type of Cookie: Advertising Cookies (Interest-Based Ads)

What it does: Bubble Approved Traders displays interest-based advertising on its website and on unaffiliated websites, using information that you make available to us when visiting the website. Interest-based ads (also referred to as personalised or targeted ads) are displayed based on information from activities such as your visits and use of these websites. Information about the types of information that we gather is set out in the Automatically Collected Information section of this Privacy Policy.

How to block: You may disable any of these cookies via your browser settings. However, if you do so, various functions of the website may be unavailable to you or may not work as intended.

Interest-Based Ads

Bubble Approved Traders utilises cookies and interest-based ads to enhance your browsing experience. In conjunction with these practices, we employ web beacons and other tracking technologies to gain insights into the advertisements you encounter and interact with across our platform and beyond. This enables us to deliver more tailored and relevant ads to you. For instance, by understanding which ads you've already seen, we can ensure you aren't repeatedly shown the same ones. Rest assured, your interaction with external websites remains unlinked to your personal identity when receiving interest-based ads from us.

In instances where tracking technologies aren't supported, such as certain mobile devices and applications, we resort to alternative anonymous methods to achieve the same goal. When serving ads within mobile applications, we collect anonymous identifiers, such as the Google Advertising ID or IDFA, specific to your device's operating system. These identifiers consist of random character strings, encrypted using a non-reversible method, to uniquely identify your device for our partners.

It's important to note that while we do not share personal information with advertisers or third-party websites displaying our interest-based ads, these entities may assume that users interacting with personalised ads are part of the targeted audience. Additionally, some third parties may furnish us with information about your online activities and demographics from various sources, both offline and online, to improve the relevance of our advertising.

Furthermore, advertisers or their representatives may employ technology to serve ads directly to your browser when visiting our website, obtaining your IP address in the process. These entities may also utilise tracking technologies to gauge ad effectiveness and customise ad content. It's crucial to recognise that we lack control over the information practices of these advertisers and third-party websites, and their use of tracking technologies is not governed by this Privacy Notice. For more details regarding their privacy practices, we recommend reaching out to them directly or visiting their respective websites.

Invoicing information may be shared with our invoicing marketplace provider for credit checks and invoicing purposes, subject to their privacy policy.

By implementing these data sharing practices, Bubble Approved Traders prioritises user privacy and ensures transparency and control over personal information.
